Player Refunds Under Brazil's Betting Ban

Medida Provisória nº 1.394/2026 sets out what happens to open bets and already-settled prizes once an operator can no longer operate in Brazil, plus the obligations that continue after its authorisation ends. This page summarises only what the MP states.

Sites and apps go offline within ten days (Art. 7)

Ten days after the MP’s publication, operators must make access to fixed-odds betting sites and apps unavailable, including in app stores, under penalty of blocking.

Open bets and already-settled prizes (Art. 7, §§2–3)

Open bets whose result has not been settled within that ten-day period are voided, with the bettor guaranteed a full refund of the amounts staked, with no deductions of any kind. Prizes from bets whose result was settled before the end of that period remain guaranteed to the bettor.

Obligations that survive the end of authorisation (Art. 10)

Even after its authorisation is extinguished or its activities end, an operator remains bound, for the period it was authorised, by: regulatory, tax and pecuniary obligations, including legally mandated allocations; anti-money-laundering, counter-terrorist-financing and weapons-proliferation-financing duties, responsible gambling and sporting integrity; and keeping the data, documents and records of its activities intact and accessible to the competent authorities for at least five years.
